Just In Time for #SocialDistancing: Florida Allows Virtual Notarization?!
Attorney Diane Vidal, with the law office of Chiumento Dweyer Hertel & Grant, explains the new law effective January 2020!
As much as it seems like the world around us has ceased all activity, many things are still moving forward. The real estate market in South Florida is plugging along with houses going under contract, first responders and frontline workers are scrambling to have the security of a will and testament, and for both of these and more, a notary is needed to complete the process. Ms. Vidal pointed out five things everyone needs to know about the new notarization law:
NOT JUST ANY FLORIDA NOTARY IS AUTHORIZED TO NOTARIZE DOCUMENTS ONLINE.
"If you're a notary in Florida, you actually have to go through a process in order to become qualified to take on a notarization online."
IDENTITY PROOFING IS MADE POSSIBLE ONLY THROUGH STATE QUALIFIED RON SERVICE PROVIDERS.
"One of the great things of doing it through the Florida Pro Vendors is that they have to confirm your identity and they do it in two different ways."
YES, DOCUMENTS REQUIRING A WITNESSES’ SIGNATURE—EVEN IF THE WITNESS IS PHYSICALLY REMOTE FROM THE SIGNOR—IS NOW POSSIBLE.
THE NOTARY BLOCK HAS CHANGED IF YOU HAVE FORMS WITH NOTARY BLOCKS MAKE SURE THEY ARE UPDATED.
"Everyone should definitely update their notarization block... just don't take that chance because it could be challenged later on!"
REMOTE ONLINE REAL ESTATE CLOSINGS ARE NOW POSSIBLE.
Your Detective of the Air also asked Attorney Diane Vidal about how this new law allowing online notarization will affect real estate transactions, and while she explained it was pretty easy to do with an all-cash deal as long as all parties agree, lenders were a little slower getting on board. However, Ms. Vidal went so far as to predict that in a few years, a more realistic closing will be totally online!
